Upon engaging The Peak HR services, you, the Client, agree to accept our Terms and Conditions. We reserve the right to change these Terms and Conditions at any time without notice and your continued use of our services following any change shall be deemed to your acceptance of such change. It is your responsibility to check the Terms and Conditions of Use regularly for changes. If you do not agree to abide by these Terms and Conditions, you must immediately stop using our services.
We may choose not to accept your request to use The Peak HR services and have the right to withdraw any goods/services at any time. All prices are subject to change at any time prior to an order being placed and are subject to change without notice. We retain the right to revoke your right to continued use of our services at our discretion
In no event shall The Peak HR be liable for any direct, indirect, incidental, consequential damages, or any damages whatsoever, including, without limitation, damages for loss of use, data, lost opportunities, arising out of or in any way connected with the use or performance of our services. The Peak HR will not be held liable or any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including without limitation, incorrect email addresses, internet failures, computer equipment failures, other equipment failures, or non-performance of third parties.
THe Peak HR make every attempt to provide accurate and quality work. However, we do not guarantee any results/outcomes from our work in assisting our Clients in obtaining and/or finding employment. We do not guarantee interviews and successful results from interviews with the assistance of our interview skills coaching and all our other services provided.
These Terms and Conditions and subsequent agreements are governed by and interpreted in accordance with the law of the State of New South Wales, Australia without giving effect to any principles of conflicts of laws. You, the Client agree to the jurisdiction of the courts of New South Wales to determine any dispute arising out of this Agreement.
ACKNOWLEDGEMENT
You, the Client, acknowledge that any document provided by The Peak HR is based solely on information provided by you and that we cannot warrant the accuracy or truthfulness of your response. The work that is produced on your behalf is a result of the information that you provide, combined with professional writing skills.Â
The Peak HR shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of its services or for the cost of procurement of substitute services. You, the Client, agree that The Peak HR entire liability, and your exclusive remedy, with respect to any service(s) provided under our Terms and Conditions and any breach of this, is solely limited to the amount you paid for such service(s).Â
The Peak HR will not be liable for the Client and the Client waives any right it has to claim, any loss of income, loss of profit, production, contract, customers, goodwill, opportunity or business, or any indirect, special or consequential loss or damage of any nature whatsoever arising under or in connection with writing services or interview skills coaching, or these Terms and Conditions, whether in contract, tort (including negligence), under statute, in equity or otherwise.
You, the Client agree to hold harmless and indemnify The Peak HR, and its employees, agents and representatives, from and against any third party claim arising from or in any way related to your use of the service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature.
You, the Client acknowledge and agree that The Peak HR will retain ownership of all Intellectual Property created as a result of or in connection with the Interview Skills Coaching Services, Resume Writing, Selection Criteria Writing Services and other Services associated with the company which produce intellectual property.
REFUND AND CANCELLATION POLICY
THE PEAK HR do not issue refunds. Please note, if you change your mind after paying for our service before the initial consultation, there will be a minimum $80 cancellation fee. Refunds cannot occur after your phone consultation.
Our 30-day guarantee period applies upon receipt of your final documents, the Client will be given up to 30 days to make changes/reviews that are within reason. This is the opportunity to make accurate changes to ensure satisfaction. The Peak HR determines the scope of reasonable modifications. If after the 30-day period you require further changes, charges will apply.
If you wish to make any changes within the 30-day period, please send a written request, briefly outlining your request to your consultant.
INFORMATION PROVIDED BY YOU
Any personal information you may provide to The Peak HR is protected by the Privacy Policy associated with this site. You agree not to provide any information or materials to The Peak HR that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another. The Peak R are not liable for any injury or damage caused by omissions, false statements, or other inaccuracies.
PRIVACY POLICY
To be able to perform to the highest level, The Peak HR require information from you. All correspondences may also be collected and stored in regards to sales, support and accounts including email and other form of communication. Any information or detail collected by The Peak HR is required in order to provide a high level of service and a quality end product. We do not permanently store Credit Card details and The Peak HR follow industry standards to protect personal information presented to us.
The Peak HR may at its discretion use other third parties to provide essential services on our site or for our business processes. These third parties are prohibited from using your personally identifiable information for any reason. We may only share your details with third parties with the purpose of providing our agreed upon service, Â
We reserve the right to disclose your personal identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served.
We reserve the right to modify this privacy statement at any time.
PAYMENT
The Peak HR will only commence working on requested products and services once receipt of payment has been received and all required and appropriate information has been received from the client. Proof of purchase must be provided for your order to proceed. The prices quoted by The Peak HR are in Australian Dollars and all transactions are conducted in Australian dollars with GST included.

Under no circumstances shall The Peak HR be liable to you for any amount for services rendered pursuant to this agreement. To the maximum extent permitted by applicable law, you hereby release, and waive all claims against The Peak HR and its employees and agents from any and all liability for claims, damages (actual and consequential), costs and expenses (including litigation costs and attorneys fees) of every kind and nature, arising out of or in any way connected with the use of the Service.
